  1. Introduction

Meytier Inc. is a Delaware corporation headquartered in New York, NY (“Meytier”). We (Meytier) have designed an AI-based and analytics-powered platform that seeks to eliminate unintended, unconscious bias to help candidates find career opportunities with Employers that are committed to diversity. We match Candidates with the right job opportunities and guide them through the job search process. We enable enterprises to provide their company overview, showcase their commitment to diversity, and to list the open jobs on the Meytier platform. These enterprises may also engage Meytier for search and placement services.

By creating an account or otherwise using the Services (as defined below) in any manner, you (the “User”) are above 16 years of age. You are entering into a legally binding agreement with Meytier under these Terms of Use or interchangeably, Terms of Service (collectively “Terms”). The Terms also include our Privacy Policy which by this reference is incorporated herein. You are encouraged to review the Privacy Policy which contains information and notices concerning Meytier’s collection and use of User personal and non-personal information. Please note that by agreeing to the Terms you are also agreeing to be bound by the provisions of our Privacy Policy.

For the purposes of this Agreement, the collective term “Services” shall mean one or more of the following services rendered by Meytier: (1) Assist job seekers in improving their resumes; (2) Assist job seekers in finding job opportunities; (3) Assist job seekers applying for jobs online; (4) Provide job board (one per company), job listings, and web pages for companies; (5) Using Meytier’s proprietary scoring and Intelligent Matching engine, help in expanding the pipeline for diverse candidates who make it through initial screening; (6) Provide assistance in additional expansion of pipeline by way of alternative sourcing through networks and social media; (7) Provide search services for candidates for full-time/contract hire at enterprises.

For Employers who have entered into a separate paid Master Services Agreement with Meytier, the terms of that MSA will control for such of the MSA provisions which conflict with these Terms.

By clicking on the “I Agree” button below, you will be given access to browse our Meytier website (“Website”), or to complete the registration process. However, you first represent that (1) you have read and understood the Terms, and that you agree to be bound by the Terms of Service, (2) you are of legal age to form a binding contract with Meytier, and (3) you have the authority to personally agree into the Terms of Service or that you are authorized to represent the company or other organization you have named as the user, and to bind that entity to these Terms.

  1. Modifications

We may update or modify these Terms from time to time in our sole discretion with or without notice. The most current version of these Terms will be posted on Website. When changes are made, Meytier will make a new copy of the Terms available at the Website and any new additional and/or modified Terms will be made available at various points in these Terms relating to the affected Service on the Website. We will also update the “Last Updated” date at the top of the Terms of Service. Changes to these Terms will be effective as of the date of posting or notice to you whichever is earlier unless a later date is specified in which event, the update shall take effect as of the later date. Your continued use of the Services will constitute your implied acceptance of the changes to the Terms. If you do not agree to one or more changes, modifications, or updates, you must stop using the Services.

We may in our sole absolute discretion, modify, add to, suspend, or discontinue any feature(s) of the Services or even the entire Services altogether, or remove any content at any time for any reason, without prior notice to you. Unless explicitly stated otherwise, all content, all Services, and every feature which in any manner affects the Services are subject to these Terms.

  1. Accounts

You are not required to provide your personal information to us unless you create an account with us (“Meytier Account”) in which case, you will have to give us certain personal information if you want to have access to Services, or be able to use some of the Services (such as applying for jobs, saving jobs you like, receiving recommendations on improving your resume, etc.). If you choose not to create or to not continue to maintain a Meytier Account, you may still access certain features as a visitor to our website. You are reminded however that your access and use of the Services, whether as a visitor or as a Meytier Account holder, is subject to these Terms.

Your Meytier Account is for your personal, non-commercial use only and you must provide complete and accurate information when creating such an account. You are responsible for maintaining the confidentiality and security of your account information, including any usernames or passwords, and are solely responsible for the activity that occurs on your Meytier Account. You may not create an account for someone else or allow someone else to use your Meytier Account. You agree to notify us immediately of any actual or suspected unauthorized access to your Meytier account, or use of your username or password, or any other breach of security related to your Meytier Account. If your Meytier Account has been canceled by us, or if you have been removed or otherwise been blocked from the Website for any reason in our sole discretion, you may not continue to avail of the Services.

You may cancel your Meytier Account at any time by sending an email to contactus@meytier.com. If your Meytier Account is canceled, we have no obligation to maintain, delete, or return to you any of the account’s content or other personal information you may have posted through your use of the Services unless you specifically request such deletion in accordance with our Privacy Policy At the time you register an account and at any time thereafter, your account may be subject to regular verification, including but not limited to, validation against third-party databases, or for identity verification through government databases including security agencies (e.g. FBI). You authorize Meytier directly or through third parties, to make any inquiries necessary to validate your identity and confirm ownership of your email address.

  1. Job Applications

Meytier allows professionals to get an overview of employers that are committed to diversity, browse open positions, and apply for jobs. Job postings on our Website allow Meytier Account holders to complete and submit job applications directly through our Website. Other job postings on our Website may redirect you to the applicable employer’s career page where you will be able to submit an application without creating a Meytier Account. Additionally, although we are not obligated to, we may provide you with the option within your Meytier Account to save information relating to applying for jobs such as a favorite list of employers, job openings to apply for later, uploading a resume, cover letter, or other professional information. The collection of any such information is governed by our Privacy Policy.

  1. Links to Third-Party Websites

The Website may direct you via hyperlinks or in some other manner to third-party websites that are not owned or maintained by Meytier. We are not responsible for your use of such third-party websites and we disavow any responsibility whatsoever concerning the content of such websites, the accuracy of any information posted on such websites, or for anything else you may find there. The inclusion of any such link to a third-party website is intended to assist you in your job search or related activities. It does not in any way imply any association between us and the owner(s) or operator(s) of such third-party websites. Your use of any third-party websites is governed by the terms of such third-party websites.

  1. Meytier’s Role

YOU ACKNOWLEDGE AND AGREE THAT MEYTIER MERELY PROVIDES A TECHNOLOGY PLATFORM. MEYTIER IS NOT RESPONSIBLE FOR ANY HIRING DECISIONS AND HAS NO INFLUENCE OVER ANY POTENTIAL EMPLOYER. EVERY EMPLOYER HAS SOLE CONTROL AND AUTHORITY OVER ALL HIRING DECISIONS.

  1. Services & Payment terms

The Services described above include a variety of products and services that are free to use (“Free Services”) as well as certain products and services that require payment (“Paid Services”). We reserve the right to move any Free Service to the Paid Services column at any time, or to revise the price for Paid Services at any time. We currently don’t have paid services for Candidates. Should we add paid services in the future, if you purchase any of our Paid Services, you agree to pay us all applicable fees and other applicable taxes (see below). You hereby authorize Meytier to collect fees for Paid Services either directly or for the sake of convenience via a third-party payment processor. Failure to pay these fees will result in the termination of the applicable Paid Service. If you are directed to a third-party payment processor, you may be subject to terms and conditions governing the use of that third-party’s service and that third-party’s personal information collection practices.

Please note that Meytier is not liable for any bank fees, foreign exchange fees, or differences in prices based on location. Meytier or its third-party payment processor may store and continue charging you for your ongoing use of Paid Services (e.g., your credit card), or for other Paid Services that you may buy.


User Content & License


You provide Meytier with the unabridged right to access, read, preserve, and disclose any content or information you include in creating, or in maintaining your account in accordance with our Privacy Policy


We do not acquire ownership of the content (blogs, company information, etc.) you post to the Website, but by posting any content to the Website, you agree to grant us a universal, perpetual, sub-licensable, commercial, royalty-free, and irrevocable license to use, copy, reproduce, process, adapt, modify, create derivative works from, publish, transmit, display, and distribute such content, in all media and distribution methods now known or hereafter devised, and you represent to us that you have the right to grant such a license. You agree that this license includes the right for other users of the Services to modify your Content, to make your Content available to others for the publication, distribution, syndication, or broadcast on other media and services. Such additional uses by Meytier or others may be made with no compensation paid to you with respect to the Content that you submit, post, transmit, or otherwise make available through the Services. Any feedback, comments, or suggestions you may provide regarding the Services is entirely voluntary and we shall be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you. We reserve the right, but do not have any obligation to, remove or block any Content at our sole discretion, at any time, without notice to you and for any reason (including, without limitation, upon receipt of claims or allegations from third-parties or authorities relating to such Content or if we are concerned that you may have violated these Terms), or for no reason at all. If the Content you submit to the Services contains your personal information, your right to access that personal information is governed by our Privacy Policy


The Website and Services also contain content posted by Meytier and/or by one or more of our licensors (“Meytier Content”). We and our licensors retain all right, title and interest in and to such Meytier Content, and all associated intellectual property rights, including without limitation, copyrights, trademarks, trade secrets, trade names, trade dress, logos, patents, know-how, trade secrets, instructions, and all other proprietary information irrespective of whether such information has been protected, or can be protected. Subject to your compliance with these Terms, Meytier grants you a revocable, limited, non-exclusive, non-transferable license, to access and view any Meytier Content solely for your personal and non-commercial use. You agree not to sublicense, copy, distribute, display, disseminate, reproduce, or otherwise exploit any Meytier Content or Services without our prior written permission.
The trademarks, logos, trade names, and service marks, whether registered or unregistered (“Trademarks”) displayed on the Website are Trademarks of Meytier and its third-party licensors. Display or use of any Trademarks by Meytier shall not be construed as granting you, by implication or otherwise, directly or indirectly, any license or right to use any Trademark without the prior written permission of Meytier or such third-party. You also agree not to use our trade dress, or copy the look and feel of the Website or its design, without our prior written consent.

Meytier allows you to use the Services and post content for a variety of purposes. You understand and agree that you are solely responsible for compliance with any and all laws, rules, regulations, and tax obligations that may apply to your use of the Services. In connection with your use of the Services, you agree that you will not:

  1. Violate any local, state, provincial, national, or other law or regulation, or any order of a court.

  2. Run any bots, spiders, scrapers, web crawlers, indexing agents, or other software to aggregate or browse any Meytier content, including without limitation, company or user accounts or profiles, or otherwise interfere with or circumvent the integrity of the Website or Services.

  3. Introduce any viruses, trojan horses, worms, time bombs, cancelbots, corrupted files, or similar software to the Website or Services or transmit any other computer programming routines that may damage, interfere with, or surreptitiously intercept any data, or personal information.

  4. Use the Services to transmit, distribute, post, or submit any confidential information concerning any other person or entity, including, without limitation, photographs of others without their permission, personal contact information or credit card, debit card, or bank account numbers.

  5. Stalk, harass, interfere with, or disrupt the access of any user of the Services, or collect or store any personally identifiable information about any other user without explicit consent from the user.

  6. Defame, defraud, mislead, or impersonate any person or entity, or otherwise misrepresent yourself or your affiliation with any person or entity.

  7. Post false information, including without limitation, in respect of a job, company, or your own credentials as a job applicant.

  8. Infringe, violate, or otherwise interfere with any copyright, trademark, or other intellectual property rights of another party including Meytier.

  9. Act in any manner which, in our sole discretion is objectionable, interferes with the proper working of the Services, or which may affect our reputation in any way.

  1. Disclaimers

The disclaimers in this section apply to the maximum extent allowable under applicable law.

You are solely responsible for your use of the Services and we are not responsible for the activities, omissions, or other conduct, whether online or offline, of any other user . You are solely responsible for ensuring that your use of the Services is in compliance with all laws, rules, and regulations applicable to you. We make no representations concerning any content contained in or accessed through the Services.

The Services are provided “as is” and without warranty of any kind, whether express or implied, including the warranties or conditions of merchantability, fitness for a particular purpose, accuracy, or non-infringement, all of which are expressly disclaimed. Meytier does not warrant that: (a) the Services will be secure or available at any particular time or location; (b) the Services will function without errors; (c) any defects or errors will be corrected; (d) any Content or software available at or through the Services is free of viruses or other harmful components; or (e) the results of using or relying on any Content or Services or advice contained therein will meet your requirements or produce desired results. Your use of, or reliance on, the Services or any content is solely at your own risk.

While Meytier will use reasonably available commercial security tools to protect the personal or other information that users insert into their respective accounts, or as visitors, we cannot and do not guarantee the security or confidentiality of users’ information from hackers, or other unauthorized actors.

  1. DMCA Notices.

It is our policy to terminate the account of any user who repeatedly infringes copyright notice of such violation is served on Meytier by the copyright owner or the copyright owner’s legal agent. Without limiting the foregoing, if you believe that your work has been copied or posted on the platform or through the Service in a way that constitutes copyright infringement, please provide our copyright agent with the following information: (1) an electronic or physical signature of the persona authorized to act on behalf of the owner of the copyright interest; (2) a description of the copyrighted work that you claim has been infringed; (3) a description of the location on the platform or Service of the material that you claim is infringing; (4) your address, telephone number and e-mail address; (5) a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; and (6) a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.

  • Limitation of Liability.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MEYTIER BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY LOST PROFITS OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, OPPORTUNITIES, OR REPUTATION ARISING FROM YOUR USE OF THE WEBSITE, CONTENT, OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW, YOU AGREE THAT IN NO EVENT SHALL THE AGGREGATE LIABILITY OF MEYTIER, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE, OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY, OR ANY OTHER LEGAL DOCTRINE OR THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICES EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM OR ONE HUNDRED DOLLARS, WHICHEVER IS GREATER.

  • Indemnification.

You agree to indemnify, defend and hold harmless Meytier, its affiliates and each of their respective principals, shareholders, agents, officers, directors, consultants, agents, representatives, and employees from or against third-party claims, damages, payments, deficiencies, fines, judgments, settlements, liabilities, losses, costs, and expenses (including attorneys’ and other professional fees) arising from or relating to any third-party claim, suit, action or proceeding arising out of or related to your use or purchase of the Services, your violation of the rights of any third-party or person, or your breach of these Terms or any representation or warranty contained herein. Meytier reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Meytier, and you agree to cooperate with Meytier’s defense of these claims. Meytier will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

  • Governing law

New York law without reference to any other conflict of law provisions, governs these Terms of Service and any Order Forms and Supplemental Terms, as well as any claim, cause of action or dispute that might arise between you and Meytier, without regard to conflict of law provisions. For any such claim, cause of action or dispute, you agree and consent to the exclusive jurisdiction and venue of the state and federal courts of the State of New York, City and County of New York. In the event of a dispute arising out of the Terms of Service or anything related to Services herein, and prior to either party initiating legal action relating to such agreements, the parties agree to attempt to resolve any dispute by good faith negotiation.

  • Discrimination

This website is designed for job seekers to empower them to represent themselves well and find new jobs and to help Employers improve diversity in their workforce. Meytier otherwise does not discriminate against any User because of race, color, national or ethnic origin, age, religion, disability, sex, sexual orientation, gender identity and expression, veteran status or any other characteristic protected under applicable federal or state law.

  • Miscellaneous

These Terms, together with the Privacy Policy and any other legal notices published on the Website, as amended from time to time, shall constitute the entire agreement between you and Meytier concerning your use of the Services. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Meytier at any time without restriction. If any provision of these Terms is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. If two or more provisions of this Agreement are deemed to conflict with each other’s operation, Meytier shall have the sole right to elect which provision remains in force. Meytier’s failure to assert or enforce any right under these Terms shall not constitute a continuing waiver of such right against a future violation, or a waiver of any other right.
The Terms do not create a partnership, franchise, joint venture, agency, fiduciary, or employment relationship between the parties.
The platform and Services may be accessed from countries other than the United States. The Website and the Services may contain references to services that are only available within the United States and U.S. territories. Any such references do not imply that such services will be made available outside the United States. If you access and use this Website outside the United States you are responsible for complying with all applicable local laws and regulations.
